What is Form I-821, Application for Temporary Protected Status?

USCIS Form I-821, Application for Temporary Protected Status is used to register or renew registration to temporarily stay in the U.S. and receive TPS benefits. The U.S. may designate a county for Temporary Protected Status due to conditions in the country that may make it dangerous for that country’s nationals to return. Examples include wars and natural disasters.

During the designated temporary period, TPS beneficiaries:

  • Are not removable from the United States
  • Can obtain an Employment Authorization Document (work permit)
  • May be granted travel authorization

I-821 should not be used by DACA candidates. Instead, DACA candidates use I-821D, Consideration of Deferred Action for Childhood Arrivals.
